These Terms and Conditions ("Agreement") are entered into between the customer ("You" or "Customer") and Mooovie ("We," "Us," or "Company") for the hire of home/outdoor cinema equipment and related services. By placing an order with us, you agree to be bound by these terms.
1. Booking and Payment:
1.1 To secure your booking, we require a deposit of £50, which should be paid along with your completed booking form. Bookings without the deposit will not be guaranteed. The deposit will be refunded within 48 hours after the equipment is collected, provided that a thorough inspection confirms the equipment is in working order (more details shown below, 2.10). Daytime bookings are between 11:00 - 16:00 and night time bookings are between 18:00 - 09:00 (following day). Nevertheless, our team will make every effort to be as flexible as possible to accommodate your needs. 1.2 An order confirmation and invoice will be promptly sent to the customer via email, ensuring receipt no later than the event date. Full payment is required prior to the event, either on the day before the event via bank transfer or in cash upon equipment setup. 1.3 Additional charges may apply for extra services or equipment not specified in the initial booking. 1.4 Prices are subject to change without prior notification for unconfirmed bookings. For confirmed bookings (with the deposit received), the prices will remain fixed unless additional items are added or a different package is requested.
2. Setup, Delivery/Collection and Inspection:
2.1 We will deliver and set up the equipment at the agreed-upon location and time. 2.2 You are responsible for providing accurate delivery details and ensuring someone is present at the venue during the agreed delivery time. 2.3 Setup time is subject to availability, and delays due to customer unavailability may incur additional charges. 2.4 The company will make its best effort to deliver the equipment at the agreed-upon time. However, the company shall not be held responsible for late deliveries that are beyond the company's control. 2.5 Deliveries within a 20-mile radius of the company's base are included in the package price. However, any additional mileage beyond this radius will incur an extra charge, which will be billed to the customer. Further details regarding these charges will be confirmed during the booking process and specified on the final invoice. 2.6 The cost of setup is included in the prices of our packages. Customers are responsible for ensuring that the venue is properly cleared before our arrival. Failure to do so may result in additional charges if the setup time exceeds a reasonable duration. 2.7 For outdoor daytime bookings, it is highly recommended that the customer positions the screen in a heavily shaded area, preferably under a dark-colored gazebo or marquee. The company provides its own blackout gazebo option to ensure optimal viewing conditions for daytime events. However, if the customer decides to make alternative arrangements, the company will not be held responsible for any issues related to poor picture quality. 2.8 If the customer opts to stream live or online content, the company will not be held responsible for any issues related to poor picture quality, such as buffering and pixelated imagery, caused by insufficient WiFi or mobile network connection. Similarly, if the customer chooses to project older or lower resolution content, the company shall not be held accountable for any resulting poor picture quality. 2.9 Collection details will be confirmed during the booking process. If the customer is not available for the equipment collection, the company reserves the right to charge a waiting fee. 2.10 After the event, a visual inspection of the equipment will occur at the venue to ensure it appears to be in the same condition as when delivered. However, a comprehensive inspection will be conducted after collection to confirm that everything is in proper working order. Depending on the outcome of this inspection, the £50 deposit will be returned to the customer, as outlined in Clause 1. Any issues or concerns related to the inspection will be communicated as promptly as possible.
3. Equipment Use and Care:
3.1 You agree to use the equipment responsibly and follow any instructions provided. 3.2 Any damage to the equipment during your event will be your responsibility, and repair or replacement costs will be charged accordingly. 3.3 Equipment must not be moved from the agreed setup location without prior consent.
4. Cancellation and Refunds:
4.1 Cancellations made less than 72 hours before the event may result in the company retaining the deposit for the cancelled event, unless the customer chooses to reschedule for an alternative date. 4.2 The company acknowledges that weather conditions may interfere with the customer's planned use of the equipment. However, the company urges the customer to have a backup plan for any outdoor viewings. Under no circumstances can an outdoor viewing proceed if it is raining. The company will strive to be as flexible as possible to accommodate changes to the booking due to bad weather. On the day of the booking, the company will contact the customer to discuss alternative arrangements, which may include moving the cinema indoors, utilizing the company's larger waterproof gazebo, or rescheduling the date. 4.3 In case of unforeseen circumstances or equipment malfunction, we reserve the right to cancel the booking. A full refund or alternative date will be offered.
5. Liability:
5.1 We do not accept liability for any injuries, damages, or losses caused during the use of our equipment. 5.2 You agree to indemnify and hold us harmless against any claims, costs, or expenses arising from your use of the equipment. 5.3 The customer is responsible for ensuring that the equipment is handled in a respectful and safe manner during the event. For any event with attendees under the age of 18, the customer, or another adult (aged 18 or above) nominated by the customer, must supervise the equipment at all times. While the company will arrange for the equipment to be set up in the safest position at the venue, the customer remains ultimately accountable for all health and safety aspects during the event.
6. Privacy:
6.1 We may collect personal information for the purpose of providing our services. Your data will be handled in accordance with our Privacy Policy.
7. Miscellaneous:
7.1 These terms constitute the entire agreement between the parties and supersede any prior agreements or understandings. 7.2 We reserve the right to amend these terms at any time, and the updated terms will apply to new bookings. By hiring our services, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions. If you have any questions, please contact us before confirming your booking.
